FBN BR LLC Market Intelligence Services
FBN BR LLC (Provider, us, our) and provides paid crop marketing newsletters and related services (Services) detailed below. By clicking “I ACCEPT” below, you agree to be bound by these Terms of Service (Terms).
THESE TERMS ARE A BINDING CONTRACT BETWEEN YOU AND FBN BR LLC (COLLECTIVELY “FBN COMPANIES,” “WE”, “OUR" AND “US”). ACCESS AND USE OF THE SERVICES ARE PROVIDED TO YOU ON THE CONDITION THAT YOU ACCEPT THESE TERMS. BY ACCESSING OR USING THE SERVICES, YOU AGREE TO THESE TERMS. IF YOU DO NOT ACCEPT THESE TERMS, YOU MAY NOT ACCESS OR USE THE SERVICES.
IMPORTANT NOTICE: DISPUTES ABOUT THESE TERMS OR RELATING TO THE SERVICES GENERALLY MUST BE RESOLVED BY BINDING ARBITRATION AND ON AN INDIVIDUAL BASIS ONLY.

Please also review our general Terms of Service at https://www.fbn.com/terms-of-service for terms that are also applicable to the Services. In the event of a conflict between these Terms and our Terms of Service, these Terms govern.
Services: The Services initially consist of the following and may be updated by us from time to time upon notice to you:
Weekly and daily market commentary providing context on recent changes in select commodity markets a well as important market factors to evaluate looking forward
Pricing Recommendations, including price targets and percent sold recommendations using cash contracts for select commodities
The Services are offered on a subscription basis, either monthly or annual, based on your election when you sign-up. You can change your selected plan. Your access to the Services is conditioned on your continued payment of all applicable fees, which are subject to change, as set out in the "Price Adjustments" section below.
Free trial. If your subscription is a free trial, payment will be due immediately upon expiration of your free trial. If you have a valid credit card on file with us, we will automatically charge that card upon expiration of your free trial. You may cancel your subscription within one day of trial completion to avoid a charge by calling (605) 223-4927.
Recurring Charges / Automatic Renewal Conditions. A credit card is required to activate your access to the Services. We may automatically renew your membership at the price then in effect (see Price Adjustments, below), and you consent to us charging your credit card accordingly. If you do not wish to automatically renew your membership, please contact us at least two (2) business days before your expiration date to avoid any additional charges. If you cancel after your expiration date, you may be charged for the applicable renewal period and your cancellation would take effect the following renewal period, subject to applicable law. We will not send you statements. Receipts for recurring charges can will be emailed to you. If you revoke authorization for us to charge you, or if for any reason your payment issuer does not submit payment, we reserve the right to or temporarily suspend or cancel your access to your account.
Price Adjustments. We may modify pricing plans for the Services at any time. If we modify a membership plan which renews automatically, we will give you notice at least two (2) days before the beginning of the renewal term in which those modifications will take effect. If your subscription is thereafter renewed or deemed to have been renewed, as applicable, such renewal shall incorporate the new plan and you authorize us to charge you accordingly.
Payment Methods. For the Services, we only accept credit cards payments. You are solely responsible for any additional transaction fees associated which may be levied in connection with these payment methods. We may partner with third parties, such as NACHA, Stripe, Plaid, and participating banks ("Financial Institutions"), to implement these payment methods and you are solely responsible for reviewing and complying with their terms and conditions.
Cancellation. You may cancel your subscription at any time. No refunds will be provided. To cancel your membership, contact FBN Support at 1-844-200-FARM or support@farmersbusinessnetwork.com.
Content. The Services includes content that is protected by copyright law and you agree that you will not use, copy, reproduce, modify, translate, publish, broadcast, send, share, transmit, distribute, perform, upload, display, license, sell or otherwise exploit for any purpose whatsoever the content contained in the Services without our prior consent, which can be withheld by us in our sole discretion and for any reason whatsoever.
