I entered into a yellow pea contract with FBN in the winter of 2018 for 2019 production year. Terms of the contract were the peas were supposed to be picked up on the farm by June 30, 2020, paid within 15 days of transfer of title. I have roughly 10,500 bushels. As of July 21 they have only picked up 3 loads, claiming they cannot find trucks to get them hauled away. These three loads they did get were picked up June 20. At first I was very upset because they had 1.5 years to get the freight figured out, but then I cooled down and realized that things happen, and they promised them gone soon (this was two weeks ago). Still no trucks have shown up. A week ago, Orion, the marketer I dealt with, promised me that I would receive half of my production contract guarantee the next day. 4 days later I received a check for 20% of my contract. It wasn't even enough to cover the bushels that have been already delivered, not to mention the value they used for the price was $.25 less than the contract price. Everyone I talk to blames everyone else, no one will get to the bottom of anything. They are breaking the terms of their own contract in terms of not paying within 15 days of delivering the bushels they picked up, breaking ND state law by not paying within 30 days of delivery, and by not picking up all contracted bushels by June 30 as stated in their contract. Needless to say, I am extremely disappointed by all of this. I have a neighbor who is having the same problems. I am hoping someone higher up the chain of command at FBN reads this and can help me because who I have been working with is clearly inept at his job. I havent had to use an attorney for these matters in my farming career yet, but looks like this might be the first time.
